FMB/GI 0511, 0551 & 0575 - Notice Given to Agent

The insurers declined the claim for the loss of the insured vehicle on the ground of late notification of loss. The insured maintained that the loss was notified and the relevant documents were submitted to the insurance agent, BH Motors, as soon as possible. The insurers maintained that BH Motors was not registered as their agent and that their agent was under personal name of Mr. N.

The Mediator was furnished with a copy of letter faxed to the insurers using BH Motors letter head requesting for the necessary claim form. It was observed that from the note at the top of the letter it was from the agent, Mr. N. The letter head BH Motors is his trade name. Thus the letter was in fact from Mr. N. The letter from Mr. N indicated that he had received the full details of the loss of the insured vehicle soon after the loss. The insured had complied with the policy condition requiring him to give notice of the loss with full details as soon as possible. Accordingly the Mediator held the insurers liable to indemnify the insured for the loss of the insured vehicle.
