/FMB/GI 0421 - Notice Given to the Agent

The insured vehicle was reported stolen on 23.3.2005. The insured notified the loss and submitted the relevant document on 24.3.2005 to Mr. S, the agent who issued him with the Cover Note. The insurers declined the claim on the ground of late notification of loss as they only received the claim documents on 5.5.2005. The insurers further maintained that Mr. S was no longer their agent as he had been suspended since 25.10.2004.

Enquiry with PIAM revealed that Mr. S was the insurers' registered agent for the period 1.10.2003 to 30.9.2005. The insured would not know that the agent had been suspended by the insurers. It is not the business of the insured to probe into the internal affairs involving the insurers and their agent. As far as the insured is concerned he had notified and submitted the relevant documents pertaining to the loss of the insured vehicle to the insurance agent one day after the date of loss.

In the circumstances the Mediator held the insurers liable to indemnify the insured for the loss of the insured vehicle.
