FMB/GI 0597 - Windscreen Damage Claim

The insured submitted a windscreen damage claim to his insurers following an accident to the insured vehicle. The claim was declined on the ground that there were other damages to the insured vehicle. The insurers' decision was based on Endorsement 89 of the policy which provides as follows :-
"In consideration of the payment of additional premium… we will pay the cost of reinstating any glass in the windscreen…. of your vehicle following breakage of such glass (provided there is no further damage to your vehicle)…"


The insured maintained that there were only minor damages (dent) to his vehicle for which he does not intend to file own damage claim. His intention was to claim for the damaged windscreen.

Upon verification with PIAM on the purpose and intention of Endorsement 89, the Mediator held that Endorsement 89 is a specific benefit under the policy which does not affect NCD and excess. To take advantage of this benefit, the damage must only confine to any glass in the windscreen or window. Accordingly the Mediator confirmed the insurers' decision to decline the insured's claim.
