FMB/GI 0168, 0507 & 0532 - Claim for Loss of Parts of Vehicle
In the above three cases referred to the Mediator, the insured vehicles were broken into and numerous parts of the vehicles were discovered missing or damaged. The insurers repudiated liability in all three cases on the ground that the loss does not fall within Section A of the private car policy.
The Mediator found on the facts of each case that the loss of or damage to the parts of the insured vehicles was due to malicious act, a peril covered under Section A(1)(g) of the private car policy. Accordingly the Mediator held the insurers liable to settle the insureds' claims.
